Terms of Service

1. Acceptance of Terms

By subscribing to the AWNK service or using our website, you confirm that you have read these Terms and agree to be fully bound by them. If you do not agree with any provision, please do not use the service.

2. Service Description

AWNK is a subscription service that provides small and medium-sized businesses with an intelligent agent operating on WhatsApp, replying to their customers' inquiries and following up on their requests on their behalf.

3. Eligibility and Registration

• The subscriber must hold the legal capacity to represent the subscribing business.
• All information provided must be accurate and up to date, and the subscriber must update it upon any change.
• The subscriber is responsible for maintaining the confidentiality of their account login credentials.

4. Plans and Subscription

Monthly Plan: 399 SAR/month. Annual Plan: 3,990 SAR/year (saving 798 SAR). Founders' offer: 299 SAR/month for the first 10 customers (monthly only).

The plan includes up to 3 branches. Additional branches (the fourth and above) are charged at 99 SAR/month per branch (activated when the payment gateway becomes available).

Free Trial: 7 full days, with Professional plan features, no credit card required.

Subscriptions renew automatically unless cancelled by the subscriber before the end of the current cycle.

5. Payment and Cancellation

Payment: Currently, payment is made via bank transfer or other agreed approved methods. The online payment gateway is under development.

Cancellation Policy:

• Monthly Subscription: The subscriber may cancel at any time. Fees are charged only for the elapsed period, and amounts paid for completed periods are non-refundable.
• Annual Subscription: The subscription cannot be cancelled before the end of the contractual year. However, the subscriber may request a full refund within 14 days from the start of the annual subscription. After this period, no refunds will be issued.

6. Nature of AI-Based Service

AWNK relies on artificial intelligence to generate its replies based on the data provided by the subscriber. Despite our care for accuracy, replies may occasionally contain errors or incomplete information.

The subscriber remains responsible for reviewing their business settings, verifying the accuracy of information provided to AWNK, and periodically monitoring important conversations.

7. Acceptable Use

• Using AWNK for any purpose contrary to Saudi regulations is prohibited.
• Attempting to manipulate or misuse the service is prohibited.
• Using the service to send spam or misleading content is prohibited.
• Using the service for any purpose conflicting with Meta / WhatsApp Business policies is prohibited.

Fair Use: AWNK reserves the right to review, restrict, or limit any unusual usage pattern beyond the normal commercial inquiry expected from a real customer (such as an abnormal volume of messages within a short period), in order to maintain service quality and stability for all subscribers.

8. Intellectual Property

All rights relating to the AWNK trademark, website design, underlying technology, and related documents are reserved for the platform owners. They may not be copied or reused without prior written permission.

Subscriber data (business information, conversations) remains the property of the subscriber and is processed in accordance with the Privacy Policy.

9. Limitation of Liability

The AWNK service is provided "as is," and we do not guarantee it will be entirely free of faults or interruptions. AWNK shall not be liable for any indirect or consequential damages arising from use of the service.

AWNK's liability, in all cases, is limited to the subscription value paid for the last 3 months.

10. Service Termination

• AWNK may suspend or terminate the subscription of any user who violates these Terms, without prior notice in serious cases.
• The subscriber may cancel their subscription at any time through the official communication channels.
• Upon termination, the subscriber will be provided with a copy of their data within 30 days of the termination date.

11. Complaint Resolution Mechanism

We are committed to a clear mechanism for resolving your complaint at no cost:

• Responding to your complaint promptly through the communication channel stated below.
• Updating you on the complaint's progress at least every 5 days until it is closed.
• Notifying you in writing within 30 days of the complaint date, accepting or rejecting it with reasons stated.

If the dispute is not resolved amicably, you may refer to the "Commercial Complaint" application, the unified number 1900, the government "Taqdeer" platform, or the Committee for the Resolution of Violations and Disputes.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Kingdom of Saudi Arabia, and the competent Saudi courts and judicial authorities have jurisdiction over any dispute arising from them.

13. Cookies

Our website may use essential cookies for its proper operation, and we will not use tracking cookies for marketing purposes without your notice. For details, see our Cookies Policy.

14. Force Majeure

AWNK shall not be liable for any delay or breach resulting from circumstances beyond its reasonable control, such as failures of external service providers, natural disasters, or governmental decisions.

15. General Provisions

• Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and AWNK.
• Severability: The invalidity of any provision does not affect the remaining provisions.
• Assignment: You may not assign your rights to a third party without AWNK's written consent.
• Notices: Notices sent via the registered email or WhatsApp are considered valid.
• Language: The Arabic version is the legally controlling version.

17. Amendments to These Terms

AWNK may amend these Terms from time to time to keep pace with regulatory or operational developments. Any update will be published on this page, with the "last updated" date revised. Your continued use of the service after the update is published constitutes implicit acceptance of it.
